These Terms of Service ("Terms") govern your use of the HealthWise AI website and application (the "Service"), operated by HealthWise AI("HealthWise AI", "we", "us", "our").

1. Acceptance of the terms

By creating an account, subscribing to a paid plan, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy and Refund Policy. If you do not agree, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. The Service and no insurance advice

HealthWise AI is an educational and informational tool for exploring health-insurance options. We are not a licensed insurance broker or producer. AI responses, plan comparisons, and cost estimates are informational only and are not professional advice, a binding quote, or an offer of coverage. Always confirm plan details with the insurer or a licensed broker before purchasing coverage.

3. Accounts

You must provide accurate information and keep it up to date. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorized access.

4. Subscriptions, billing, and Merchant of Record

Our order process is conducted by our payment provider Stripe. Stripe acts as the Merchant of Record for our subscription orders and provides payment processing, invoicing, tax calculation and remittance, refund processing, and chargeback handling on our behalf.

Paid subscriptions renew automatically at the interval you selected (monthly, unless otherwise stated) until you cancel. You can cancel at any time from your account billing page, which opens the Stripe-hosted customer portal; your access continues until the end of the paid period. Prices are shown in your local currency where supported and may include applicable taxes.

Payment, billing, cancellation, and refund mechanics are governed by these Terms and our Refund Policy, together with the applicable terms of our payment provider.

5. Acceptable use

You agree not to, and not to attempt to:

  • use the Service in any unlawful, fraudulent, or deceptive manner;
  • infringe the intellectual-property or privacy rights of others;
  • upload malware, viruses, or other harmful code;
  • scrape, probe, or interfere with the security or integrity of the Service, or bypass rate limits, authentication, or usage restrictions;
  • resell, sublicense, or share access to the Service outside your account;
  • reverse engineer, decompile, or attempt to derive source code, except where such restriction is prohibited by law;
  • use the Service to send spam, harassment, or to solicit personal health information from third parties;
  • use the Service to make regulated professional decisions (medical, legal, or financial) without qualified human review.

6. Intellectual property

The Service, including all software, content, design, branding, and documentation, is owned by HealthWise AI or its licensors and is protected by intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for your own personal or internal business purposes. You retain ownership of the content you submit; you grant us a limited license to host and process it solely to provide the Service.

7. Suspension and termination

We may suspend or terminate your access if you materially breach these Terms, fail to pay, create a security or fraud risk, or repeatedly violate our acceptable-use policy. You may stop using the Service at any time by deleting your account.

8. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

9. Limitation of liability

To the maximum extent permitted by law, HealthWise AI will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our aggregate liability arising out of or relating to the Service is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law (e.g. for fraud or personal injury).

10. Changes

We may update these Terms from time to time. Material changes will be posted here with an updated "Last updated" date; continued use of the Service after changes take effect constitutes acceptance.
